US Court Mandates Freedom of Abrego Garcia from Immigration Detention

A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her order.

The case originates in a mistaken deportation to El Salvador in March, which the government later admitted was an error. After his return to the United States to answer human smuggling allegations, he was detained in federal custody.

In her order, the court noted that the government does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."

Background of the Case

The legal challenge center on disputed assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.

He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing trial in the state of Tennessee.

Conditions of Release

The court, who was hearing his petition to deportation in a Maryland district court, ruled that he must now comply with the conditions of his release from jail in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.
